OUR BEST ALCOHOL BEVERAGE RESULTS
Since as early as 2013, the attorneys at Garner, Ginsburg & Johnsen, P.A. have built a reputation as the go-to brewery, winery, and distillery attorneys in Minneapolis by helping dozens of clients get their businesses up and running, obtain financing from private investors, protect their brands, draft and negotiate distribution and other agreements (e.g., contract production), resolve internal ownership disputes, litigate a variety of issues, and navigate a complex regulatory regime governing the production and sale of alcoholic beverages. Read some of these true stories:
BUILDING A BREWERY FROM MALT TO HOPS
A client with a passion (and talent) for brewing excellent beer reached out to us to help him start a brewery. We helped him form a company, draft securities offering documents so he could raise the capital necessary to open a brewery, negotiate a lease, and register trademarks. We have also worked with this client to expand production through the entry into new strategic agreements and helped it resolve various trademark disputes.
CROSS-BORDER DISTRIBUTING
Our client, a Wisconsin brewery, wanted to be able to self-distribute their beer into Minnesota, rather than working through a third-party distributor. This had historically not been permitted by Minnesota, but we communicated with the state of Minnesota on their behalf and succeeded in obtaining the right for this client to self-distribute in Minnesota.
WHAT’S IN A FARM WINERY?
Farm Wineries in Minnesota are a category of businesses that are given a special status under Minnesota’s liquor laws. Our client wanted to open a business that fell within the statutory requirements for this special business type. We assisted the client in navigating the processes of business formation and licensing requirements to be able to operate as a Farm Winery.
